The Law Reform Commission has engaged Marsden Jacob Associates, in association with M+K lawyers to assist with an inquiry into compensation regimes for persons suffering from asbestos related diseases. Specifically, the team has been engaged to:
- prepare a discussion paper examining the key issues, drawing from a robust literature review;
- coordinate and undertake a comprehensive community and stakeholder consultation; and
- prepare a final report which draws from consultation responses and makes clear recommendations in relation to the Commission’s terms of reference.
The review is seeking to form a recommendation in relation to potential modifications to the ‘once and for all rule’ as it currently applies in Western Australia compensation law. Further, aspects of law dealing with ‘provisional’ damages and damage for the value of service provided by the plaintiff to others are also included in the review.
